Terms and Conditions

AURA Strength Studio – Personal Training & Online Coaching

This agreement applies to all services provided by AURA Strength Studio, located in Venlo, Chamber of Commerce (KvK) 92761178, VAT ID NL004979003B39, e-mail selenasmitfitness@gmail.com, website www.aurastrength.nl.
By accepting this agreement in Virtuagym, the client (hereinafter: “Client”) declares to have read, understood, and accepted its contents.

1. Services
AURA Strength Studio provides:
Personal Training at the studio in Venlo;
Online fitness coaching via Virtuagym (including training and nutrition programs, check-ins, and guidance);
Digital products (such as programs or e-books).

2. Duration and Termination
Subscriptions for online coaching and personal training can be entered into for a fixed term of 3 or 6 months.
After this initial period, the subscription will automatically convert into an indefinite agreement.
Once converted into an indefinite agreement, the Client may cancel the subscription at any time with one month’s notice.
Personal training credits are valid until the expiry date stated in Virtuagym.

3. Cooling-off Period and Right of Withdrawal
The Client has a statutory cooling-off period of 14 days starting from the day the agreement is concluded. Within this period, the agreement may be terminated without giving reasons.
If the Client requests the personal training or online coaching to start immediately within this cooling-off period, the Client agrees to pay a proportionate amount for the services already provided.
If the service is fully completed within the cooling-off period, the Client agrees that the right of withdrawal will lapse.
For digital content not supplied on a tangible medium (such as e-books or digital programs), the Client agrees that delivery will start immediately and that the right of withdrawal will therefore lapse.

4. Cancellation and No-show
A personal training session may be cancelled free of charge up to 24 hours in advance. For later cancellation or absence, the session will be forfeited and the full lesson will be charged.
Online coaching can be temporarily paused in consultation, for example in the event of illness.

5. Payment
All prices include VAT (9% for personal training and e-books, 21% for other services/products).
Payment must be made in advance via the payment methods offered by Virtuagym.
In the case of direct debit, the Client authorises that monthly amounts may be collected. Reversal of payment (chargeback) does not release the Client from the payment obligation.
In case of late payment, access to services may be suspended and collection costs may be charged.

6. Performance and Expectations
AURA Strength Studio provides services with care and professionalism but does not guarantee specific results. The success of a program depends partly on the Client’s own effort, lifestyle, and circumstances.
The studio may reschedule training sessions or appointments in cases of force majeure (e.g., illness), without liability for damages. Services not performed will then be reasonably compensated in consultation.

7. Health and Own Risk
The Client declares to be in good health and physically able to participate in exercise to the best of their knowledge. Relevant medical information (including injuries, pregnancy, conditions, medication use) must be reported in advance.
Participation is at the Client’s own risk. AURA Strength Studio is not liable for any damage or injury, except in cases of intent or gross negligence.
In case of pregnancy or medical conditions, the trainer may impose additional conditions or temporarily refuse participation in the interest of safety.

8. Intellectual Property
All training programs, nutrition plans, videos, and other materials remain the property of AURA Strength Studio. The Client is granted only a personal licence for private use. Sharing or distributing this material is not permitted without prior written consent.

9. Privacy (GDPR)
AURA Strength Studio processes personal data solely for service delivery, administration, and legal obligations.
Personal data is secured and only shared with necessary processors (such as Virtuagym or payment providers).
The Client has the right to access, correct, or delete personal data. Requests can be sent to selenasmitfitness@gmail.com.

10. Complaints and Disputes
Complaints can be sent by email to selenasmitfitness@gmail.com with the subject “complaint.” The Client will receive a response within 14 days.
Dutch law applies to this agreement. The competent court in Limburg has jurisdiction to hear disputes.
For agreements concluded online, the Client may use the EU Online Dispute Resolution (ODR) platform.

11. Amendments
AURA Strength Studio may amend these terms and conditions. In the event of changes that are disadvantageous to the Client, the Client will be notified at least 30 days in advance. In such a case, the Client may cancel the agreement free of charge.

12. Client’s Consent (by acceptance in Virtuagym)
By accepting this agreement in Virtuagym, the Client declares:
To have read and understood the terms and the privacy policy;
To agree to the immediate start of the services if requested, including the corresponding limitations of the right of withdrawal;
To agree that the right of withdrawal for digital content lapses once delivery has started;
To acknowledge that participation is at their own risk and that AURA Strength Studio is not liable for damage or injury, except in cases of intent or gross negligence.
